Due Process of the law, a legal principle, is a guaranteed right that was provided to us by the Constitution and it simply means we have protections. These rights that are guaranteed to us are â€Å"life, liberty and property without a chance to defend them†; some also believe that we also have the right to a â€Å"pursuit of happiness†. (Bill of Rights). When we think about Due Process we need to think fair process or fair procedures. This practice is known as Procedural Due Process. â€Å"Standing by itself, the phrase â€Å"due process† would seem to refer solely and simply to procedure, to process in court, and therefore to be so limited that â€Å"due process of the law† would be what the legislative branch enacted to be† (Heritage.org/constitution) . The Fifth Amendment states that we have the right to due process. Which if you are accused of a crime it means that the accusers must show fair and reasonable circumstances. Due process means that you have the rights to show cause and be taken to court swiftly. This process is called an arraignment. This right is one of the guarantees of the Fifth Amendment. The Constitution clearly defined and separated federal and state powers. The Constitution also provides the protection of individual rights which include but are not limited to a trial by jury if it is a criminal case. Because of the fifth and the fourteenth amendment we have certain guaranteed due process of law simply means that we have protection against a chance deprivation of life, liberty or property. The fourteenth amendment is the actual key that opens the door for the federal government to make sure that the states laws are lining up with the Constitution and the Bill of Rights. The Clause In other words and basically means â€Å"fundamental fairness†.(Constitution and the Bill of Rights). The definition of fairness is the condition of being just and impartial. That is what is alluded to and a guaranteed of the federal and state laws and is inclusive. In 1787 a United States Constitution was drafted with a system of checks and balances by the creation of the executive, legislative and federal judicial branches of government. The Framers of the Constitution did not consider it a necessity to include a specific right in the bill of rights. At first when the Bill of Rights was put together it was not inclusive of  all people. Especially, people of color remembering they were slaves and owned by the framers of the Constitution. It wasn’t until the Civil War was won by the North was the Bill of Rights and the Constitution revised and amendments were added. The thirteenth amendment was the one that made sure that there was no longer slavery. By the end of the eighteenth century, citizens felt that a written constitution was an absolute must. The Constitution was not inclusive of certain rights. â€Å"There was an absence of specific guarantees of individual rights such as the right to free speech, freedom of religion, due process of law, and freedom from governmental search and seizure.† (Legal Dictionary,Due Process). Federalist and Anti-Federalist had very lively debates the Federalist was against and the Anti-Federalist were for the bill of rights. The leader of the Federalist was Alexander Hamilton, he was so opposed to including the bill of rights because he did not see the necessity. The federalist most of them were slave owners there was no need to list specific rights since the national government could execute only the limited powers authorized to it in the Constitution. (Samaha 31-32) The limitation of federal government powers ensured individuals from federal interference. James Madison, convinced the bill of rights was necessary to ensure acceptance of the Constitution, started to draft the original bill of rights. Hurtado v. California was decided in 188, this particular case rejected the idea of due process. This case involved Joseph Hurtado and Jose Estuardo what was so interesting about this case is that these two gentlemen were friend. Jose Hurtado was seeing Joseph Hurtado wife. When he asked him to leave town Hose simply replied that he would. He didn’t leave but continued to see Joseph wife. Joseph responded by shooting him once in the chest, then in the back,(Cortner 1981, 18,19). What makes this case a rejection of the due process is that the state of California refused to follow the process of a grand jury indictment by grand jury review. The prosecutors made the decision to indict Mr. Hurtado. This was a clear violation of the fifth and the fourteenth amendment. They indicted him using† charging by information† method. A long story short Hurtdo was sentenced to be hung by his neck by the judge. The decision was upheld by the state court. Hurtdo appealed to the United States Supreme Court and they decided to uphold the lower court decision. Their thought was that the state criminal procedure was a local matter and  none of the federal government business. Much to my surprise I thought they would overrule the state’s decision. This case was a clear violation of Joseph Hurtdo fifth and fourteenth amendment. The Supreme Court ruled in Griswold v. Connecticut, 381 U.S. 479, 85 S.Ct. 1678, 14 L.Ed.2d 510 (1965) the â€Å"intent† was to protect certain private areas from governmental interferences. The Supreme Court ruling in the Connecticut statue did prohibit the use of contraceptives was unconstitutional under the Due Process Clauses of the Fifth and Fourteenth Amendments. Individual rights such as the right to marry, the right to choose whether to keep a child or to abort the child,(Roe vs. Wade), is the choice of the individual and not the government. Another case that I want to discuss is the Scottsboro Boys whose rights were taken advantage of. They were people of color who were accused of throwing so white boys off the train and also accused of raping two white girls. There were nine of them one was only twelve, another was blind in one eye and only had ten percent vision in the other eye. These gentlemen were tried and convicted to death by electrocution. There was popular support for the Scottsboro boys. A long story short it was ruled that denying a right in the Bill of Rights violates fundamental principles of liberty and justice which lie at the base of all our civil and political institutions† (Samah,33) It embraced within the Due Process Clause of the Fourteenth Amendment.† I think that it is so important that the fore fathers of our country put in place the Fifth Amendment and the fourteenth amendment guarantee us due process. I believe that my long term results of earning my degree will be to help me find a job in my field of study. I think that the value of my education is priceless. I feel this way because you cannot put a price on education and knowledge. There is nothing greater than knowing that I completed my courses and could graduate from college. No matter what my age is when it happened. My personal plan for my academic future will be to graduate from my courses and earn my associates degree and possibly moving on to earn a bachelor’s degree.While earning my bachelor’s degree I can start to intern as an accountant and gain the experience necessary to further my career. I think that by doing these two things I will be more educated and qualified as an Accountant. With me gaining the experience and becoming more educated I will have a better chance for receiving a position that I have applied for because I do have the educational know how and experience. I have learned a large amount about being in a collaborative learning environment. I find this experience to be very helpful and have enjoyed working with my fellow classmates.They have allowed me to express my thoughts and views on a topic and also have helped my views and opinions to grow with theirs. As we absorb the news of a famine, an earthquake, a hurricane, a tsunami, sometimes we tend to put ourselves in the position of the victims and wonder how we would react. In such situations, most people act instinctively, and what they do is more spontaneous than calculated. That spontaneity is usually the subconscious reflection of character, and because fife for most of us is lived on an even keel, how we behave in emergency is largely unpredictable, unless we have been previously conditioned to react in certain ways. The recent earthquake in Manner gave me a vivid example of two contrasting reactions to the same event. The house of a man received a direct hit from the earthquake which killed one of the daughters of the family. The father was a sincere Christian. He fell on his knees and prayed for the souls of the victims. The following day, what remained of his possessions lying round the shattered house were looted. Indian Creation Stories Essay After reading the Iroquois and Pima creation myths in the book, I have been very intrigued by the Native American beliefs of the creation of the earth. It seems that nearly every tribe has a different belief of how it happened, though some are very similar. The Huron tribe, originally from the St. Lawrence Valley, have a very similar belief of creation as the Iroquois, where the Cherokee tribe had a totally different view than the Pima. The Iroquois and the Huron myths are both in the Earth-Diver category. In this type of myth, animals swim deep to the bottom of the water and bring up dirt in their mouth, forming the earth. Just like the Iroquois, in the Huron myth, a divine woman falls out the sky and is swept up just before hitting water by a hawk. The hawk then calls down in the water for help, for she is too heavy for it to hold by itself. First, a turtle comes out the sea for her to sit on, and then he instructs other animals such as ducks, beavers, and even a muskrat. After the earth is built, the woman gives birth to twins, but soon dies after giving birth to her two sons. The sons in both myths represent good and evil on earth. They were to prepare the earth so that humans could live on it, but they found out that they could not live together. So, they separated, with each one taking their own portion of the earth to prepare. Once older, the good son creates a sun and moon out of the remains of its mother’s body. It continues to create the world, forming vegetation and other useful tools to help humans survive. Meanwhile, the evil brother made outrageous animals, violent and disturbing. He made wolves, bears, venomous snakes, and panthers of giant size. He made massive mosquitos, the size of wild turkeys, and he made an enormous toad, it drank up the fresh water that was on the earth. The good brother then had to kill the toad to bring water back to the land. In the end, the good brother defeated the evil brother in a fight, sending the evil brother’s soul to the center of the earth. Pima creation myth is similar to the Iroquois and Huron myths in that there are both animals that help build the earth, except in the Pima myth, they are land animals instead of sea animals. Also, there are two main characters that represent good and evil. The Cherokee creation myth starts as the world being completely covered in water and earth merely being an island floating bove the seas suspended by four rawhide ropes. There were no people, and the animals lived above the rainbow. The animals sent the water beetle under the seas to search for more room, and it brought up mud that spread quickly, turning into land. Although at first the land was to soft and flat, Godfather buzzard went to check on the land and the wind from his wings created mountains and valleys, thus why the Cherokee territory has many mountains. As the new ground stiffened, the pulled the sun from behind the rainbow and raised it higher in the sky. The next thing created was the plants, and view animals were given the privilege to see at night. People were created last, with the women being able to have babies every seven days, the Creator feared that the world would soon become crowed and made it so women could only have one child a year. The Native American creation stories of the Iroquois and Huron are almost identical where the Pima and Cherokee are completely opposite of each other. This goes to show just how different the beliefs of different Indian tribes are, and how this holds true to how there are different beliefs across the United States still today.

Homeschooling: Academics, Socialization and College Admissions Prospects Homeschooling is probably one of the least known and least understood issues in education. Many people tend to think that most homeschoolers are religious conservatives or extremists. However, the truth is that people from all walks of life are joining the homeschooling bandwagon (Ray, 2004). The main misconception is that homeschooled children don’t get the same academic and social education as traditionally schooled children. Contrary to popular perception, homeschooled children have the same, if not better academic opportunities, social opportunities and college admissions prospects than traditionally schooled students have. According to Mary Griffith, author of the book The Homeschooling Handbook, the concept of homeschooling is nothing new to society. It is only in the past 150 years that public school system as we know it came into effect (Griffith, 1999). Prior to that, â€Å"†¦the family was the basis for social life†¦the home was where children learned what was necessary to function in their community† (1999). By the mid-1970s, there were barely any people practicing homeschooling (Ray, 2004). However, over the past twenty years there has been a resurgence in people choosing homeschooling (2004). There has been a 500 percent increase in homeschooling from the 1990-1991 school year to the 2002-2003 school year (2004). In the context of the idea of â€Å"Nationalism†, what are the differences between the Scottish National Party and the British National Party? BODY OF WORK Being today a central issue of the modern world, Nationalism, a term from nasci which means â€Å"to be born†, has most of the time been considered as a 19th century phenomenon, connected to the development and creation of nation-states .While seen by a large number of critics as outdated in other word old, not just because it is inherently expansionist but also destructive, others in meantime see it as a strength to re-enforce order and solve conflict. Thus, the issue of nationalism will therefore depend on a system every country adopts. If we take the United Kingdom(UK),a constitutional monarchy and unitary states which is composed of four(4) countries :England(London),Northern Ireland(Belfast),Wales(Cardiff) and Scotland(Edinburgh) has been governed by a Parliamentary system.However,it is argued that nationalism w ithin the UK is both reactionary and progressive . The simply reason of this statement is that in different parts of UK,the notion of nationalism has components of both looking towards the future inclusively and progressively but ,also looking to their past regressively thus hoping to bring back their historical period.Britain and Scotland, being among these parts of UK, have for a centuries had political parties sometimes based on similar ideas but most of the time different from each others. The British nationalism referring to the nationalist ideas and policies’ application to the United Kingdom tends to promote the UK as a goal for national identity, social movements, comprises political and sentiment inspired by the love of British language, culture , history and ot forgotten the pride of being British. Supported ,politically from the Euro scepticism of the conservative United Kingdom Independence Party and far-right British national party to the centre-right conservativ e Party and the left-centrist Liberal Democrats, British nationalism has had a progressive cause characterised by â€Å"a powerful but ambivalent force in British politics†.From this British nationalism, a party called the British national party will be one of our aim studies in this topic. As for Scotland, Nationalism being a political ideology and created in 1921 as primarily body based in London and largely influenced by Sinn Fein ,has most of the time supported greater autonomy for Scotland as part of the United Kingdom, but also the creation of a sovereign state.In which case Scottish nationalism can be referred to three (3) main elements: -The Scottish Independence with the advocacy of Scotland becoming a sovereign state -The Scottish national party with the main political party that support Scottish Independence. -The Scottish home rule, an organisation knew before the Devolved Scottish Parliament was created in 1999 that had for purpose to give Scotland the autonomy w ithin the British Empire. From this nationalism , derived a national party called the Scottish national party.It is therefore in the process Nationalism that, our aim target will be to identify the differences between the two major national parties in the United Kingdom known as the British National Party (BNP) and the Scottish National To begin with, we should start by saying that the Scottish National Party (SNP), a civic party with strong democratic leanings and non-nationalist was first created in (1934) having as aim to promote justice, caring and enterprising community by making Scottish potential as an independent nation in the mainstream of modern Europe.Wishing to be completely independent from Britain, the Scottish national party has always wanted to be a separate state making its own decisions not just in Europe but throughout the world, this is why Scottish political parties such as, the SNP encourage progressive attitudes that are principally based on two main(2) things :the long term desire to become but also the ambition to be entirely inclusive with global organisation such as Europe . While the British National Party, reated in (1982) by a group of the National Front with John Tyndall, is a far-right, fascist political party combined with a white supremacy organisation that stands for anti-non british,because it believes that there are significant differences between races, one of the party’s main objectives is to restore by legal methods white ethnicity, which existed prior to 1948 in a way that anything that does not fit their narrow stereotype is meant to be kept away from the party.Adding to this, it has to be said that the British national party adoring men like Adolf Hitler of German Nazi is almost claimed to be a Nazi political party as well. Another reason that makes the difference between the two parties is that, the Scottish national party has always wanted an open door to all races and nationalities in the sense that even non- Scottish people have been accepted to be members of the party without forgetting the fact that this was the first party to have a Muslim MSP as member.After independence, anyone living in Scotland could claim a Scottish citizenship under the SNP constitution with an open door policy on immigration compared to Britain ,where immigration still a dominant issue thus blaming immigrants for any possible problem . It is even believed that the British national party has for wish to put the white British- born before immigrants and non- british,stopping immigration and repatriate people of different races, presently living in the UK to the respective countries .In a speech given by Nick Griffin ,the actual leader of the British national party(BNP),he declared that â€Å"it is probably now too late to anticipate a return to the status quo ante 1948 â€Å" therefore suggested a new model of â€Å"milti-culturalism†. This model was meant to lead by a policy of cultural and biological separation ,not by principles of integration, this could allow people to enjoy each other’s culture and tradition but each staying on their own in order to avoid â€Å"diversity† which could be but a short –lived stepping stone to nothingness.An expected outcome of the method as Tyndall said, was going to be in the image of a south-African apartheid-style system with like he said â€Å"separate communities of people –Indian ,Pakistani, Bangladeshi(Hindu and Muslim),African and Afro-Caribbean and heaven knows what else-living side by side in Britain in separate enclaves†. This is to show that although immigrations issues were trying to be solved there were nevertheless still based on strict principles that had to be followed. Principles that were completely different from the one the Scottish national party made.These days, the Scottish national party does not have a lot to deal with national parties in eastern and central Europe particularly becaus e most of them are rather right wing ,among them men like, Michal Kaminski of the polish law and justice party. Also, in the European parliament for Freedom and fatherland party, it will be noticed that men like David Cameron will definitely be comfortable to sit with Latvia whereas it would be hard if not never for the Scottish party to Roberts Zile from the FFF to the next Bannockburn shindig.This is to prove that racism is not a big concern in Scottish nationalism because there is no race problem in Scotland. Moreover, there are also differences regarding the concern of the British and Scottish public as a whole. While Scotland is much more concerned about the unemployment as a big problem to face, Britain on its side is more worried about the economic field which is very frequent nowadays.In the other hand, crime, law and order are very serious matters in Britain than in Scotland where it is more likely to be concerned about the education. Furthermore ,another difference between the British national party and the Scottish one is that, the Scottish national party, being left wing is very focused on what people living in Scotland will be in the future regardless what the religion or skin colour are, while the British national, being right wing wants to go back to their old values.In terms of Military issue, providing that it is the government in Westminster that is in charge to send soldiers at war, Scotland plays a very small part in sending soldiers for defence ,war and terrorism compared to Britain that is more concerned about this issue. To conclude with this topic, it shall be said that although, these two are different parties in different countries, the differences between them is all about Racism, Immigrations and Political issues.In terms of racism, the British national party states that their constitution has for purpose, the preservation of the ethnic and national typical character of the British people themselves . Analyzing Ethical Behavior Essay

In the course of this report, it will show the comparison of the ethical aspect of two well-known corporate giants, Enron and Bernie Madoff. The first subject Bernard Lawrence â€Å"Bernie† Madoff, Broker, Investment guru, Financier. Once herald as a financial king, he in his reign overnight turned white collar criminal, which led to a quick and easy demise. Second, Enron Corporation, known for energy and commodities, services, and well known for being a major player in the electricity and natural gas, and communication, pulp and paper company, crumbled to its knees into bankruptcy in the early 2000s. The question is, at the height of both these two companies, what went wrong. Where was the ethical breakdown? The who, what when and the why will be the focus of this report. Bernie Madoff, former chair of NASDAQ, started his parent company on Wall Street Bernie L. Madoff Investment Securities LLC, 1960 it was as the top of its game-bypassing firms who were specialist in the field of finance. Hijacked by Madoff’s firm with their signature OTC†¦Over the Counter orders with brokers. The company employed family and close friends that comprised of his brother Peter, Managing Director, his niece (peter’s daughter) Shana Madoff, compliance officer and attorney, and his two son’s Mark and Andrew. It was told by Madoff’s sons that their father made damaging statements, and confessed to them that the business was a lie, that it was a Ponzi scheme from the beginning, which led Federal agents to arrest Madoff, and all those involved. Madoff told authorities that the scheme began in 1990, but according to the FBI, it was started early as the 1970s. It has been reported that Madoff’s trial of deceit led his scheme to accumulate as much as $65 billion, with a reported estimate loss to investor of $18 billion. â€Å"Reports of ethical violations by upper level managers continue to multiply despite increasing attention being given to ethics by firms and business schools. Much of the analysis of these violations focus on either these manager’s lack of operation principles or their willingness to abandon principles in the face of competitive pressures† (Ludwig, 1993). Enron Corporation is the second in this detailed report of the fall of power. Traded on the NYSE: ENE, and based in Huston, Texas was an energy, commodities, and services company. For six consecutive years, Enron was named by Fortune Magazine as â€Å"America’s Pioneering Business†, with claimed revenues of $101 billion in the year 2000. What do most companies base their ethics upon; Enron’s code was one of Respect, Integrity, Communication and Excellence, described as treating others as they would be treated. Apparently they did not abide by that one in particular because as we go through this report, it will soon show the where the breakdown began. Integrity, working along with customers through honesty, Communication, obligated to interconnect with one another, Excellence, Not accepting anything less than the best in all that we do. These are just a few statements from Enron’s code of Ethics handbook. Given this code along with the assurance to professional ethics, it causes one to ponder these questions. How could a company dramatically collapse with reported revenues of $101 billion? With an increase the first, three quarters in 2001, falling into major bankruptcy in December of that same year. Could it be that the answer to these questions is a failure of the top leadership, a corporate culture caused the demise in its ethical beliefs along with the complicity of investors and the financial institutions? Enron’s corporate culture is described as having an appearance of arrogance that caused the public to trust that they could handle the risk without stumbling upon any danger to the company and to investors. This type of thought would make one not to sleep at night, but the implicit message from Enron was make the numbers, if you are caught stealing or cheating, ask for another chance, you may get one. You can see that Enron did not do anything to promote integrity nor respect; it was undermined by the company’s emphasis on reorganization, presentation, reparation and its considerations. To conclude, the answer as to why CEO’s have bilked their companies and investors out of billions of dollars and brought a collapse of hundreds of corporate giants, it is because unethical and criminal behavior is the morals by which they do what they have done are doing, even as this report is being written. An epidemic could explode and if nothing is done about it†¦then the American system of High Finance and Big Business will crumble to a screeching Holt and affect this country’s economy†¦. God forbid. â€Å"Destructive leaders can cause hardship not only to immediate followers, but to the broader population. For example when a large company struggles financially, it is not only employees, but customers, suppliers, and shareholders that are negatively affected. The cognitive processes employed by the leader play a large role in how he or she gathers information, interprets it, and makes decisions toward a course of action (L. Eubanks, 2010).

Obesity; Root Cause Of Many Diseases.

Obesity is a medical condition in which excess of fat has accumulated in the body and may give rise to health problems. A person is obese when his body mass index is above 30 kg/m2. Body mass index is ratio of an individual’s weight and height, and can be calculated by dividing person’s weight with square of his height. The most commonly used measure of weight status is body mass index, or BMI. Years of research have shown that BMI provides good estimate of â€Å"fatness† and correlates well with important health outcomes. For adult men and women healthy BMI falls between 18 to 25 kg/m2 .Overweight is defined as a BMI between 25 and 30; and obesity a BMI of 30 or higher. So it is important tool for clinicians trying to screen to determine who may be at risk because of carrying around too much weight for their height. More or less every region of world is facing this problem. Once a problem of wealthy nations, obesity now impacts countries at all economic levels, bringing with it a wave of ill health and lost productivity. Worldwide rate of obesity doubled since 1980, with just over 200 million adult men and just under 300 million adult women obese.Of all high-income countries, the United States has the highest rate of overweight and obesity, with fully a third of population obese, a rate projected to rise around 50 percent by 2030. Obesity is also on the rise in South Asian countries including Pakistan. According to Forbes, Pakistan is ranked 165 (out of 194 countries), with 22. 2% of individuals crossing the threshold of obesity. In Pakistan the highest concentration of the obese lies in the big cities as compared to the rural countryside. At the other times in history obesity was considered as sign of wealth and prosperity, as mankind suffered scarcity of food in the past.But now obesity has been declared as a disease by American Medical Association. Whether or not it is considered a disease, it is also an important risk factor for many c hronic diseases. Obesity is associated with many chronic heart diseases such as angina, myocardial infarction (heart attack), high blood pressure, deep vein thrombosis and more. A 2002 study concluded that 21% of ischemic heart disease is due to obesity, while a 2008 European consensus puts the number at 35%. Obesity has been cited as the main cause of high blood pressure.The risk of hypertension (high blood pressure) is five times higher in the obese as compared to those of normal weight. A definitive link between obesity and hypertension has been found using animal and clinical studies, which have suggested that there are multiple mechanisms for obesity induced hypertension. People who are overweight are at much greater risk of developing type 2 diabetes mellitus than normal weight individuals . Being overweight puts extra pressure on body’s ability to control blood glucose using insulin and therefore makes it much more likely for you to develop diabetes.Almost 90% of peopl e with type 2 diabetes mellitus are overweight. Many respiratory system diseases may be outcome of obesity such as asthma, obstructive sleep apnea etc. Obesity may be associated with variety of reproductive system diseases for example polycystic ovarian syndrome, infertility, birth defects, intra-uterine fetal death etc. Gastrointestinal diseases such as gastroesophageal reflux disease, gall stone, fatty liver are predominant in the overweight. Many types of cancers occur with increased frequency in those who are overweight or obese.A study from United Kingdom showed that 5% of cancer is due to excess weight. Certain neurological conditions are also attributed to increased body weight. Apart from associated morbidity and mortality, obesity has many social and economic implications as well. Their main source of livelihood is cattle raising, although they rarely eat beef except on some special occasions but maintain cattle herds chiefly as a milk source for them. The word Nuer means â€Å"original people† and they belong to the same ethnic group as the Dinka and Atwot (the two other main tribes living in this region) which speak the same uniform Nilotic language, with no discernible or observable dialects. The reason why they own cattle is largely cultural, in the sense it determines the political  hierarchy or social standing of Nuer men, based on the quantity and quality of the cattle herd he has.
